Assumption of Risk, Release of Liability, Waiver of Claims, and Indemnity Agreement

This Assumption of Risk, Release of Liability, Waiver of Claims, and Indemnity Agreement ("Agreement") is entered into between Pipeline Volleyball ("Coach," "we," or "us") and the undersigned participant and/or parent or legal guardian ("Participant," "you"). Pipeline Volleyball is a remote tele-coaching service: all coaching, training guidance, and film review is delivered virtually via video call, recorded video, and/or written feedback. Coach is never physically present with Participant at any time, before, during, or after any Service. By signing below, you agree to be bound by the terms of this Agreement in exchange for being permitted to participate in Pipeline Volleyball's online volleyball coaching, training, film review, and related services ("Services").
Participant understands that volleyball and physical training involve inherent risks, including but not limited to: sprains, strains, fractures, dislocations, ligament and tendon injuries, concussions, cardiac events, and other bodily injury, whether temporary or permanent, and in rare cases, death. These risks may arise from the physical activity itself, the condition of the playing surface, court, or equipment used by Participant, the actions of the Participant or others present at Participant's location, or Participant's own physical condition. Because Pipeline Volleyball provides Services entirely remotely, Coach is never physically present at Participant's training location, whether during live video sessions, independent drills assigned as "homework," or at any other time, and therefore cannot physically spot, correct, or intervene to prevent injury. Participant voluntarily assumes full responsibility for any and all risks of injury, illness, damage, or loss, known or unknown, that may result from participation in the Services, including risks arising from the Participant's own training environment, equipment, and physical exertion.
To the fullest extent permitted by law, Participant, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby releases, waives, discharges, and covenants not to sue Coach, and Coach's owners, officers, employees, contractors, and agents (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by Participant while participating in the Services, or while performing any training, drill, or exercise assigned or discussed as part of the Services, regardless of the location where Participant chooses to train, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law. This release does not apply to injury or damage caused by the gross negligence or willful misconduct of the Released Parties, to the extent such limitation is required by applicable law.
Participant represents that they are physically fit and have no medical condition that would prevent safe participation in volleyball training, or has disclosed any such condition to Coach in the Client Intake Form. Participant is solely responsible for consulting a physician prior to participation and for discontinuing any activity that causes pain or discomfort.
Participant consents to (a) live coaching sessions being recorded for Participant's own review and progress tracking; (b) game or practice film submitted by Participant being viewed, annotated, and stored by Coach for the purpose of providing feedback; and (c) Coach using clips, screenshots, or anonymized excerpts of session recordings or submitted film for marketing or educational purposes, unless Participant opts out in writing. Participant retains ownership of their own submitted footage; Coach will not distribute or sell Participant's footage to third parties.
Participant agrees to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable attorneys' fees, that the Released Parties may incur due to Participant's participation in the Services, to the fullest extent permitted by law.
This Agreement shall be governed by the laws of the State of Florida, without regard to conflict of law principles. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
PARTICIPANT (AND PARENT/GUARDIAN, IF PARTICIPANT IS A MINOR) HAS READ THIS AGREEMENT, UNDERSTANDS ITS TERMS, UNDERSTANDS THAT THEY ARE GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE, AND SIGNS IT VOLUNTARILY.
